{"id":37013,"date":"2025-08-05T16:14:14","date_gmt":"2025-08-05T14:14:14","guid":{"rendered":"https:\/\/fojustice.fr\/web\/?p=37013"},"modified":"2025-08-05T16:14:14","modified_gmt":"2025-08-05T14:14:14","slug":"enap-personnels-big-brother-a-lenap","status":"publish","type":"post","link":"https:\/\/fojustice.fr\/web\/enap-personnels-big-brother-a-lenap\/","title":{"rendered":"ENAP Personnels : Big Brother \u00e0 l&#8217;ENAP"},"content":{"rendered":"<p class=\"p1\">Le 24 juillet 2025, <span style=\"color: #ff0000;\"><span class=\"s1\"><b>FO<\/b><\/span><b> Justice<\/b><\/span> d\u00e9couvrait que les chefs de service de la fili\u00e8re CPIP \u00e9taient destinataires de mails alors m\u00eame qu\u2019ils ne leurs \u00e9taient pas adress\u00e9s.<\/p>\n<p class=\"p1\">Vous allez dire : comment cela est possible ?<\/p>\n<p class=\"p1\">Tr\u00e8s simple, d\u00e9but 2023, selon les informations transmises par la direction, ces chefs de service ont demand\u00e9 \u00e0 \u00eatre qu\u2019ils int\u00e9gr\u00e9s aux bo\u00eetes structurelles des \u00e9l\u00e8ves CPIP.<\/p>\n<p class=\"p1\"><b>L\u2019accord a alors \u00e9t\u00e9 donn\u00e9 par le directeur adjoint de la formation alors en poste.<\/b><\/p>\n<p class=\"p1\">Le v\u00e9ritable probl\u00e8me c\u2019est que ni les personnels, ni les \u00e9l\u00e8ves n\u2019ont \u00e9t\u00e9 inform\u00e9s.<\/p>\n<p class=\"p1\">Ce qui veut dire que d\u00e8s lors qu\u2019un mail est envoy\u00e9 \u00e0 un groupe d\u2019\u00e9l\u00e8ves CPIP, les chefs de cette fili\u00e8re sont en copie.<\/p>\n<p class=\"p1\">Qu\u2019est-il fait des \u00e9l\u00e9ments contenus dans ces mails ? Que sont devenus ces mails depuis plus de 2 ans ?<\/p>\n<p class=\"p1\"><b>Pourquoi ne pas avoir inform\u00e9 les \u00e9l\u00e8ves et les personnels de l\u2019\u00e9cole ?<\/b> <span style=\"color: #ff0000;\"><span class=\"s1\">Cette question m\u00e9rite une vraie <\/span>r\u00e9ponse !<\/span><\/p>\n<p class=\"p3\" style=\"text-align: center;\"><b>La transparence doit \u00eatre la r\u00e8gle ;<\/b><\/p>\n<p class=\"p3\" style=\"text-align: center;\"><b>d\u2019autant plus quand on travaille au minist\u00e8re de la Justice !<\/b><\/p>\n<p class=\"p1\">Cet agissement est une faute grave que le <b>code p\u00e9nal<\/b> condamne en son <em><span class=\"s2\"><b>article L226-15<\/b><\/span>.<\/em><\/p>\n<p class=\"p1\">Sans m\u00eame \u00e9voquer de ce que pr\u00e9voit le <em><span class=\"s2\"><b>RGPD<\/b><\/span><\/em> en ses <b>articles 12 \u00e0 15<\/b>.<\/p>\n<p class=\"p1\">Les obligations de chacun sont rappel\u00e9es dans la charte num\u00e9rique du minist\u00e8re de la justice et notamment en ces termes :<\/p>\n<p class=\"p4\"><i>\u00ab <\/i><b><i>L\u2019utilisateur ne doit pas tenter d\u2019acc\u00e9der ou de prendre connaissance d\u2019un message \u00e9lectronique qui serait <\/i><\/b><b><i>adress\u00e9 \u00e0 un autre destinataire sans l\u2019autorisation formelle de ce dernier.<\/i><\/b><\/p>\n<p class=\"p4\"><b><i>Tout utilisateur<\/i><\/b><i>, tout comme l\u2019administration, <\/i><b><i>doit respecter les dispositions l\u00e9gislatives et r\u00e9glementaires <\/i><\/b><i>relatives \u00e0 l\u2019utilisation des technologies de l\u2019information et de la communication.<\/i><\/p>\n<p class=\"p4\"><b><i>Celles-ci pr\u00e9voient en particulier les mesures interdisant<\/i><\/b><i> :<\/i><\/p>\n<p class=\"p4\"><i>[\u2026]<\/i><\/p>\n<p class=\"p4\"><b><i>Le non-respect de la r\u00e9glementation relative \u00e0 la protection des donn\u00e9es \u00e0 caract\u00e8re personnel<\/i><\/b><i>. \u00bb<\/i><\/p>\n<p class=\"p1\">Pour rappel, les personnels et les \u00e9l\u00e8ves concern\u00e9s n\u2019ont pas \u00e9t\u00e9 inform\u00e9s que leurs mails \u00e9taient \u00e9galement transmis aux chefs de la fili\u00e8res CPIP.<\/p>\n<p><a href=\"https:\/\/fojustice.fr\/web\/wp-content\/uploads\/2025\/08\/009-2025T-Big-Brother-a-lENAP.pdf\">Lire le communiqu\u00e9\u00a0<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Le 24 juillet 2025, FO Justice d\u00e9couvrait que les chefs de service de la fili\u00e8re CPIP \u00e9taient destinataires de mails alors m\u00eame qu\u2019ils ne leurs \u00e9taient pas adress\u00e9s.
